Man arrested for assaulting a grandmother in bathroom at Mother’s Day lunch
AUSTIN, Texas —
A man was arrested after he allegedly assaulted an 84-year-old grandmother inside an East Austin restaurant on Mother's Day.
According to the affidavit, police responded to a call from a woman saying her grandmother had been assaulted and the suspect was being held down by her brother at around 11:35 a.m. on Sunday.
They were having a family Mother's Day lunch at Rick's Restaurant, located at 5811 Berkman Drive.
According to police, the granddaughter said that her grandmother had to use the bathroom a lot. At one point, while she was in the bathroom, a suspect went inside the bathroom and assaulted her.
The granddaughter stated that her bother ran after the suspect and held him in the parking lot until police showed up.
According the the victim, as she went inside the bathroom, someone turned the bathroom lights off and then she saw a man peeking under the stall. Then she said the lights came back on and the suspect opened her door and slapped her on the face while she kept saying " This is the women's restroom, get out".
When officers arrived at the scene, they arrested the suspect, identified as 25-year-old Erick De Jesus Cruz-Espinoza.
According to court documents, Cruz-Espinoza looked intoxicated on an illegal substance and smelled like alcohol.
When police asked him what had happened, he responded "The lady disrespected me," the affidavit says.
Cruz-Espinoza was charged with injury to an elderly person.
