Amarillo PD: No charges for 9-year-old believed to have shot, killed 7-year-old

Amarillo police said Monday no charges can be filed against a 9-year-old child they believe killed another child during a burglary.

On May 27, Amarillo police said the 9-year-old broke into a home and found a gun. They said the 9-year-old then shot the 7-year-old victim.

The 7-year-old was found laying in the street when police responded to the scene.

On Friday, it was announced that the victim had died from their injuries. The same day, police announced that they would not bring charges against their young suspect, citing laws in Texas that do not allow children under 10 to be held criminally responsible.

As police continued to investigate, they said there was no evidence any adult had given the gun to the children.

However, police are presenting the case to the 47th District Attorney's Office for review.
